ADU fire sprinkler requirement in Charles County: Bill 2026-06 and the detached cottage.
Charles County used to cap a detached second unit at half the size of the main house and keep it out of most zones. Bill 2026-06 opened that up this summer. A homeowner in Waldorf, La Plata, Hughesville or out on the Bryans Road side can now put one ADU on the lot, attached or detached, and the county is going to see a lot of backyard cottages over the next few years. Every one of them is a new dwelling to the building code, and in Charles County that has meant a 13D sprinkler system on every new house since the start of 2016. The cottage is no different.
What Charles County allows now
Bill 2026-06, zoning text amendment 25-189, was introduced April 28, 2026, went to a public hearing on July 7, 2026 and passed the commissioners unanimously. It allows one accessory dwelling unit on any lot in a zone that permits a single family detached house. The unit can be up to 75 percent of the main house, the state figure, with two bedrooms at most, and it cannot sit on a lot with a duplex, a triplex or an apartment building. The bill was written to bring the county into line with Maryland’s 2025 ADU law before its October 1, 2026 deadline, and it did.
Does a detached ADU need fire sprinklers in Charles County
Yes. The county has not published an ADU sprinkler page because the building code already answers it. The residential code Maryland adopts requires a sprinkler system in every new one and two family dwelling, and Public Safety Article section 12-504 bars a county from weakening that provision. A detached cottage is a new dwelling on its own foundation, so it gets a full NFPA 13D system, reviewed with the building permit and tested at the final. An apartment inside an existing house that has no sprinklers is an alteration, and the code leaves that alone; a unit inside a house built after 2015, which already has sprinklers, gets heads of its own. Our statewide ADU guide and our Charles County basement guide cover the inside the house cases.
What a 13D system looks like on a small detached unit
A 600 to 1,000 square foot cottage carries six to ten heads, one riser with a control valve and a drain, and CPVC pipe in the ceiling with a cover plate on every head. Closets, small bathrooms and a garage bay with no living space above it can be left out under the standard. The design flows its two worst case heads for seven minutes on a one story unit, and that number sizes the supply. Our 13D guide covers the standard room by room.
Waldorf water or a La Plata well
In the Waldorf and St. Charles corridor the lots are on public water, and the cottage ties into the house service or its own tap. We flow test at the street before design, because a long run from the meter to the back of a deep lot loses pressure, and the test decides whether the house line carries both buildings. South and east of La Plata, and through most of the rural county toward Nanjemoy, Cobb Island and Benedict, lots are on wells. A well does not deliver sprinkler flow on its own, so the ADU gets a 300 gallon stored water tank and a booster pump in conditioned space where the well line enters, sized to the design and priced as its own line. A photo of the pressure tank gauge and the pump tag is enough for us to size it. Our well water guide covers the whole setup.
The permit path
Zoning first: the ADU approval under Bill 2026-06 comes from Planning and Growth Management, and the building permit does not move until it is in hand. Then the building permit files with the county’s Codes, Permits and Inspection Services, and the sprinkler drawings and hydraulic calculations file with it under a Maryland State Fire Marshal fire protection license. On a well lot the tank and pump are on the first plan set. Rough in is inspected with the framing and includes a pressure test on the pipe, and the final is an acceptance test with the inspector before the unit is occupied. General plumbers cannot legally design or install the system here; our guide to hiring a sprinkler installer in Charles County explains what the license means and why the county checks it.
What it costs
A cottage is priced as new construction. The fixed parts of a system, the riser, the valve, the permit and two inspections, are a larger share of the bill on 800 square feet than on a full house, so plan on the top of our published new construction range per sprinklered square foot, and add the tank and pump package on a well. Both ranges are on the cost page. The number we send comes from the plans and holds through the final.
When to call us
As soon as the plan set exists and before the water line to the cottage is sized. On a well, before the tank location is settled, because the tank goes where the well line comes in, on a slab, in conditioned space, and has to fit through the door. Send the zoning approval, the plans and the gauge photo, and we flow test or size the tank and send a number before you commit to a builder. If the unit is an apartment over a garage, our detached garage guide shows where the heads stop.
